General conditions of use

This document establishes the General Conditions for the use of the Colejobs portal (hereinafter, the "Portal" or "Website"), for the services offered by Colejobs, SL.

In addition to these General Conditions, certain services, due to their particular nature, may also be subject to Specific Conditions. These General Conditions are built on and completed by the notifications made, the Help sections and other applicable terms and conditions. Use of any of the Services offered on the Website implies express acceptance of the General Conditions in force at the time, the Specific Conditions and other applicable terms and conditions.

Conditions of Use

In general, users agree to use the content and services of the Website in accordance with the terms of the law, public morals, public order, the General Conditions and applicable Specific Conditions. Users also undertake to make correct use of the services and content of the Portal, not using them for illegal or criminal purposes or in any way violating intellectual or industrial property regulations or any other applicable legislation. For those services which allow users to publish content on the Portal, users undertake that all such content will comply with the law, public morals, public order, the General Conditions and applicable Specific Conditions.

In particular, and without limitation, users undertake:

• Not to publish racist, xenophobic or pornographic content, apology for terrorism or any content which may infringe on human rights legislation.
• Not to publish programs (virus or harmful software) which could damage the computer systems of the access provider, their providers or users of the internet.
• Not to divulge user names and passwords to any non-authorised third parties; if your password becomes known to any non-authorised user, you are required to report this fact immediately.
• Not to publish, transmit or make available to third parties any content which attacks the fundamental rights and freedoms recognised under the Constitution of Spain and in international treaties and laws.
• Not to publish, transmit or make available to third parties any content which violates intellectual or industrial property rights, patents, trademarks or copyright held by Colejobs, SL or by third parties.
• Not to publish, transmit or make available to others any content which may constitute illicit or unfair advertising.
• Not to transmit unsolicited or unauthorised publicity, junk mail, chain letters, pyramid schemes or any other form of solicitation, except in those areas (i.e. commercial areas) specifically created for such purpose.
• Not to supplant other users using their user names or passwords to access the services or contents of the Portal.

Intellectual and Industrial Property

The content to which users may have access through the Website is subject to industrial and intellectual property rights, patents, trademarks or copyright, held by the owner of the Website or by third parties. Accordingly, access to this content does not entitle the User to alter, amend, use, reproduce, distribute or publish any such content, or grant them any rights corresponding to the right-holder in question. Accordingly, users are expressly prohibited from making any use of such content other than merely private use, as set out herein.

Users undertake to use the content to which they have access through the Website for their own use and needs, and in no case to make any direct or indirect commercial use thereof.

Amendments

Colejobs, SL reserves the right to make any changes it considers necessary, and may amend, remove and include content and/or services, and the manner in which they are presented and located, unilaterally and without giving prior warning. Likewise, users accept that Colejobs, SL reserves the right to amend and update the General and Specific Conditions, and to introduce, cancel, amend and update terms of payment. Unless stated otherwise, the introduction of any feature which may amend the current services and/or the introduction of new services, are subject to these General Conditions.

Exclusion of guarantees

Colejobs, SL accepts no liability for any losses or damages incurred owing to inaccuracy, non-exhaustiveness, failure to maintain information updated, or any other errors or omissions in the content of the Website or in any other content accessed via the Website, and accepts no responsibility for verifying or monitoring said content.

Likewise, Colejobs, SL does not guarantee availability, continuity or infallibility in the operation of the Website and, consequently waives all responsibility (as far as allowed by current legislation) for any losses or damages incurred due to lack of availability or discontinuity in the operation of the Website and of the services offered therein, or for errors in access to the websites featured therein or from which the services are offered. Colejobs, SL accepts no liability for content provided by the users of the Website or for the content of external websites linked to. In particular, Colejobs, SL does not guarantee that said content is accurate or that it meets a given purpose.

Colejobs, SL accepts no responsibility for losses and damages incurred through the services offered by third parties through this Website or through means made available by said third parties to manage service applications, specifically, but not limited to: by acts of unfair competition and illicit advertising as a consequence of the services rendered by others through the Website, and by inaccuracy, incompleteness, defects, incorrectness or lack of timeliness in content transmitted, published, stored, received, obtained, made available or accessed by means of the services provided by third parties through this Website. Colejobs, SL does not intervene in selection processes, but merely offers the information services made available through the Portal. Colejobs, SL is not party in the process and accepts no responsibility for the quality, content or availability of services.

Likewise, Colejobs, SL accepts no responsibility for the opinions of the users of the Portal, forums, communities or other participation and opinion tools.

Data protection

All personal information provided by users in order to use the services and/or content of the Portal is subject to the terms of our Privacy Policy.

Hiring with third parties through the Website / Advertising on the Portal

Clients accept that all labour relationships that they may enter into with advertisers or third persons contacted through the Portal, and their participation in tenders or promotions or the purchase and sale of goods and services are solely and exclusively between client and advertiser. Consequently, clients accept that Colejobs, SL bears no responsibility for losses or damages incurred on account of their negotiations, conversations and/or labour relationships with advertisers or third persons contacted via the Portal.

Content liability

Colejobs, SL will not be responsible for the accuracy, quality, reliability, correctness, morality or legality of offers of work, courses, promotions, information, programs, information or opinions or any other content or service offered on the Portal.

Likewise, Colejobs, SL will not be responsible for losses or damages caused by virus, or for any other harmful elements which may alter the user's computer systems, electronic documents or files stored on the Portal servers. Colejobs, SL accepts no liability for losses or damages of whatsoever nature, direct or indirect, caused to clients by (not limited to):

• The use or impossibility of use of Portal services and content, in cases of force majeure, unforeseeable causes or other causes not imputed to Colejobs.
• The cost incurred to obtain goods or services, information or messages obtained, or transactions agreed through or from the Portal services.
• Amendments and/or suspensions to Portal content or services. The client assumes all responsibility for all losses or damages which may derive from access to said content, and for all losses or damages caused to their computer systems by any element downloaded or by any other manner obtained through use of the services, or for any loss of data deriving from downloading any such elements.
• Content published on the websites of the users of the Portal are the original creations of said users, unless said users expressly state that the content is owned by others; in this case, express mention must be made of the author and, as the case may be, of their website. Colejobs, SL will understand that the user has the necessary authorization for the use of such material.

Technical provisions regarding links

Users accept that they use the services and content of websites linked to at their own risk and liability, and hold Colejobs, SL harmless for any liability regarding the technical availability of the Portal, of the websites linked to therein, and the quality, accuracy and reliability of the services, information, elements and/or contents that users may access thereby and contained in the Portal's search directories.

Colejobs, SL accepts no direct or indirect liability for losses and damages caused by:

• The operation, non-availability, accessibility and lack of continuity of the websites linked to and/or available search directories.
• Failure to maintain and update the content and services of websites linked to.
• Declarations of behavior or any other type of content published by third parties on the Portal.
• Lack of quality, inaccuracy, illegality, ineffectiveness of the content and services of websites linked to.

Liability for the behavior of users

Clients admit and accept that they use the content and/or services offered on the Colejobs.es Portal at their own risk and liability. Colejobs, SL does not guarantee that users of the Portal use its content and/or services in accordance with the law, public morals, public order or the conditions of the Portal. Colejobs, SL does not guarantee the accuracy, exhaustiveness or authenticity of information published by users. Accordingly, Colejobs, SL will not be liable for:

• Losses and damages caused to third parties deriving from the use made by users of Portal services and content
• Losses or damages caused by inaccuracy or lack of completeness in the identity of users and the content they publish or make accessible to other users.

Colejobs, SL accepts no responsibility for losses or damages deriving from infringements committed by any user against the rights of any other user or third party, including copyright, trademarks, patents, confidential information and any other intellectual and industrial property rights. Users will respond for losses and damages of whatsoever nature that Colejobs, SL and its providers or partners may suffer as a consequence of failure to comply with these General Conditions.

However, in the event that Colejobs, SL or any of said providers or partners is ordered to pay any compensation as a consequence of any such non-compliance, the user agrees to compensate Colejobs, SL or its providers or partners for all expenses, costs, damages and losses of whatsoever nature (including the fees of attorneys and barristers, even when their intervention is mandatory) incurred thereby, within a term of 60 calendar days as from being sent notification to said effect by Colejobs, SL.

Right of exclusion

Colejobs, SL reserves the right to refuse or withdraw access to the Portal and/or the services offered therein, without giving notice, at their own instance or at that of any third party, to users who fail to comply with these General Conditions or the applicable Specific Conditions.

Minors

In general, minors must first obtain the consent of their parents, guardians or legal representatives before making use of the Services offered on the Portal. In this case, said parents, guardians or legal representatives will be responsible for all actions performed through the Website by the minors in their care.

Duration and Termination

The Portal services and content are offered for an unlimited time. Notwithstanding the foregoing, Colejobs, SL may unilaterally terminate, suspend or interrupt the services offered on the Portal at any time and without giving notice, without prejudice to any provisions made in this regard in the corresponding Specific Conditions.

Legislation and jurisdiction

These General Conditions are governed by the laws of the Kingdom of Spain. Colejobs, SL and the user, expressly waiving their right to any other jurisdiction to which they may have recourse, agree to be bound by the decisions of the Courts of the place of residence of the Company, in any disputes which may arise with regard to the services covered under these General Conditions. In the case of users residing outside of Spain, Colejobs, SL and the user, renouncing their right to any other jurisdiction to which they may have recourse, expressly agree to be bound by the decisions of the Courts of Valladolid, Spain.

Specific Conditions for the use of the Job Offer Service

The terms of use given here apply to job offers and CVs published on Colejobs.es and are obligatory for all registered users of the Portal. All users are required to accept these terms of use before completing the registration process.

If you see any content on this Portal which contravenes these conditions, please let us know.

• 1. All information requested when registering businesses, individuals and candidates or inserting job offers and CVs must be complete and accurate.
• 2. Colejobs.es will not accept offers:
  • That require candidates to pay a fee.
  • For pyramid schemes or similar.
  • For business opportunities.
  • Having to do with the adult entertainment industry.
  • That discriminate on rounds of race, gender, religion, opinion, nationality, disability or any other personal or social condition.
  • That may be misleading or involve illicit activity in accordance with current EU regulations.
  • Minors may not register on the site without the consent of their parents or guardians
• 3. Use correct language when writing your offers.
• 4. Information contained in offers must be clear and concise. Offers requiring the candidate to get in contact for more information regarding the business, individual or offer will not be accepted. Offers requiring candidates to call premium line numbers (800 or 900 prefixes) or any other contact involving additional cost to the candidate will not be accepted.
• 5. If you see any offer that contravenes these conditions, please contact our customer service department.
• 6. Offers that deteriorate the quality of service will not be accepted: The following offers will be rejected:
  • Duplicates: this is understood to mean offers for the same job in the same town and/or on the same or a different date. To distinguish between them, references may be used, as long as the offers are for different professional categories.
  • Offers containing contact details in the job description and requesting candidates to get in contact: the contact details of businesses or individuals may not be given in this field. Contact details will be understood as telephone or fax numbers, addresses or emails.
  • Businesses must only offer available positions. Links leading the user to employers job sections may not be inserted.
  • Each offer must refer to a single position. For different positions, different offers must be made. If there are several vacancies for a single position, this may be indicated freely in the vacancy field of the offer.
• 7. Persons inserting offers that breach current legislation will assume all responsibility for the damages and consequences deriving from same, holding Colejobs, SL harmless for all liability.
• 8. Colejobs, SL cannot control each and every offer published, and accepts no responsibility for their contents. In any case, offers and CVs will be revised regularly to ensure that these conditions are observed.
• 9. Protect your password. If other people make fraudulent use of your account you may risk losing access to the service. We recommend that you do not use your username as your password.
• 10. Non-authorised commercial emails may not be sent. Users involved in this activity will have their accounts suspended.
• 11. Portal job offers may not be sold to third parties.

Users breaching any of these conditions will be banned from the Portal.

These conditions may be amended at any time, without prior warning or notice.

The services offered are addressed to residents in Spain. Individuals or corporations resident in other countries, whether in the European Union or not, should ensure that access to and use of the Portal and its content is permitted under their own jurisdiction. In any case, access to and use of the Portal by users not resident in Spain will be understood as having been made under their own exclusive responsibility, holding Colejobs, SL harmless for whatsoever liability that may arise, insofar as permitted by applicable legislation.
